Service Agreement.
Effective: February 1, 2020

 

This Agreement is entered into between Management Information Technology USA, Inc. d/b/a ChildPlus® Software (“ChildPlus”) and the organization executing this Agreement and identified below as “Customer” (“Customer”) on behalf of itself and the agencies or partner organizations identified in this Order Form (each, for purposes of this Agreement, an “Agency”).

Standard Hosting with VPN Database Access includes the Standard ChildPlus Hosting Service Agreement plus the ability for designated Customer staff to connect directly to the source ChildPlus.net database for the purpose of performing queries, reports, data manipulation or other database tasks.
  • Customer understands and acknowledges that all persons authorized by Customer to use the VPN Database Access feature will have complete, unrestricted access to Customer database, including the ability to perform damaging actions, including deleting or altering data items, groups of items or the entire Customer database. VPN Database Access is intended for experts knowledgeable in accessing relational databases. ChildPlus is not liable for any actions performed by any Customer staff via VPN Database Access. Customer must exercise great care in designating VPN Database Access staff and must take adequate precautions to secure user IDs, passwords and any other information associated with VPN Database Access.
  • In order to take advantage of VPN Database Access, Customer must have hardware that can terminate an IPSEC tunnel and the network expertise to configure that hardware. ChildPlus will coordinate the initial setup of the IPSEC tunnel with our hosting provider, Amazon Web Services. Once the tunnel is set up, Customer will be provided with an IP Address, port number and SQL Server credentials which will allow Customer to access production, archive and training databases. Customer will then be able to access Customer databases directly through the VPN tunnel with either read-only or read-write privileges.
  • Data Errors Resulting from VPN Database Access.
  • ChildPlus is not responsible for any data errors, deletions, etc., either intentionally or unintentionally, resulting from VPN Database Access. In the event of a data error resulting from VPN Database Access, ChildPlus will restore a database backup at the request of Customer. One backup per quarter will be restored free of charge. Additional backups will be restored at a cost of $250 per restore operation.
  • In the event that data errors occur which cannot be adequately resolved via backup restoration, ChildPlus may be able to write custom data repair logic to partially or fully resolve the error. Custom data repair logic is billed at $250 per hour with a minimum of charge of $5,000. Complicated data repair operations may cost significantly more.
